A New Standard for Use of Cell Phones

February 2002

by Edward Poll, J.D., M.B.A., CMC

A Florida court may have set a new standard in auto accident cases when the plaintiff's lawyer was able to show that the defendant/driver was on the cell phone at the time of a fatal accident. The jury held the defendant negligent because of the use of the cell phone and the perceived lack of attention to the road and the victim of the crash.

Lack of focus has become a major problem for many of us. Clients say that their attorneys fail to focus on their needs and wishes as well. Fortunately, the consequences are not so catastrophic as in the Florida case. But, loss of clients can be economically devastating in the long run. This gives new meaning to Jack Canfield's book, previously discussed in LawBiz® E-Zine, "The Power of Focus."
