-<description>Have you ever experienced a trier of fact reviewing your billing records to determine what you should be paid?  In "fee shifting cases," or cases where the "losing party" (not your client with whom you have a written fee agreement) must pay the legal fees, this is done all the time. And in fee disputes with a client, there is a trier of fact (usually an arbitrator) who will review your billing records to determine whether you are entitled to all you've billed the client.  Ken Moscaret is a former business litigator and trial attorney who is now a legal fee expert and witness in fee disputes, testifying about the reasonableness of legal fees.  During our interview, Ken discloses the factors that lawyers must address if they want to sustain their legal fees. The burden of proof is always on the lawyer despite the presence of a written fee agreement. </description>
